Terms of Service
Introduction
These Terms of Service (“Terms”) govern your access to and use of all services provided by The Health Conscious Diva, LLC (“The Health Conscious Diva,” “we,” “our,” or “us”), including subsidiaries and initiatives such as Let’s Go Plant-Based Membership, HYPED in Health Summit, Purple Sol Kitchen, retreats, coaching, and all related events and services. By accessing or utilizing any of our services, you explicitly agree to comply fully with these Terms. If you do not agree, you must not access or use our services.
Services
The Health Conscious Diva, LLC provides a variety of services aimed at promoting plant-based living and wellness. These include health coaching, membership programs, cooking classes, live events, and retreats.
Health coaching involves personalized sessions to support your journey towards a healthier lifestyle. These sessions may include discussions about dietary habits, exercise, mindfulness, and wellness strategies, and are non-diagnostic and educational in nature.
The Let’s Go Plant-Based Membership provides access to resources for plant-based living, including meal plans, recipes, shopping lists, monthly challenges, priority access to workshops and events, motivation and education calls, and a support forum.
Purple Sol Kitchen Cooking Classes offer interactive sessions focused on creating nutritious, plant-based meals, with guidance on ingredient selection, meal preparation, and cooking techniques.
HYPED in Health Expo, a community-focused event featuring workshops, workouts, and healthy living resources, as well as other events promoting wellness and plant-based living.
Other Live Events range from luncheons, speaker events, cooking demonstrations, and corporate contracts.
Retreats are immersive experiences focused on relaxation, education, and wellness, with activities such as workshops, cooking demonstrations, fitness sessions, and mindfulness practices.
Disclaimer
The Health Conscious Diva, LLC and its subsidiaries (Let’s Go Plant-Based, HYPED in Health Expo, and Purple Sol Kitchen) do not practice medicine or substitute for it in any way. It is not our purpose to diagnose, treat, prescribe medications, or claim to cure any particular disease or condition. Our role is to assist willing individuals to acquire understanding of the functions of their bodies, how to preserve them in good health, how to cooperate with nature where health has declined, and to work with nature in restoring a state of wellness. It is recommended that you consult your physician prior to making any changes in your diet or lifestyle (exercise and movement included).
Use of Services
You agree to use our services only for lawful purposes and in accordance with these Terms and any additional guidelines or policies provided by The Health Conscious Diva. You agree not to access or use our services in any way that is unlawful, threatening, abusive, or harassing.
Payment
All payments must be made upfront unless there is an agreed-upon payment arrangement. Services cannot commence until full payment or the agreed-upon initial payment is received by The Health Conscious Diva in cleared funds.
Refund Policy
For health coaching, clients must demonstrate adherence to the program protocol in order to receive a refund. Refunds will not be granted if the client has not actively participated in the program or followed its guidelines.
For live events, paying customers who cannot attend will not receive a refund. Vendors may request a refund if the request is made at least two weeks before the event, allowing sufficient time for the organization to find a replacement. No refunds will be issued to vendors within two weeks of the event.
Refunds for retreats will be 100% if requested within the first 10 days of purchase, provided the request is made at least three months before the retreat date. A 50% refund will be provided for cancellations up to 30 days before the retreat. No refunds will be granted for cancellations within 30 days of the retreat. Participants are strongly encouraged to secure travel insurance to cover emergencies or illness that prevent attendance. Monies paid for a canceled retreat will be applied toward a future retreat.
Confidentiality
The Health Conscious Diva respects the confidentiality of all clients and participants. Any personal information shared during coaching sessions, membership programs, events, or retreats will be kept strictly confidential and will not be disclosed to third parties without your express consent, except as required by law. Similarly, you agree to respect the privacy and confidentiality of other participants by not sharing their personal information, discussions, or experiences outside of the designated group or event.
Indemnification
You will defend and indemnify The Health Conscious Diva from any third-party claims, damages, liabilities, losses, costs, and expenses (including reasonable attorney fees) arising from your breach of these Terms or your unlawful, negligent, or fraudulent acts or omissions.
Limitations of Liability
The Health Conscious Diva is not liable for any indirect, incidental, special, consequential, or exemplary damages arising from your use of our services. Our total liability arising from or relating to these Terms is limited to the amount paid by you for the applicable service or event in the prior 12 months.
Communication Protocols
All calls and virtual meetings must be scheduled in advance. We aim to respond to inquiries within 24 hours on weekdays. Any advice provided via email or informal conversations should be considered recommendations requiring further analysis unless formally delivered as part of a defined service.
Changes to These Terms
We may modify these Terms from time to time. If we make material changes, we will notify you through the services or by other reasonable means. By continuing to access or use our services after revisions become effective, you agree to be bound by the updated Terms.
Governing Law
These Terms are governed by the laws of the State of New Jersey without regard to conflict of law principles. Any dispute arising from these Terms must be brought exclusively in the federal or state courts located in Delaware, and you consent to personal jurisdiction in these courts.
Termination
We may terminate your right to use our services if you breach these Terms or engage in unlawful or fraudulent activity. Upon termination, your right to access and use our services will immediately cease. Clauses intended by their nature to survive termination will survive termination.
Entire Agreement
These Terms constitute the entire agreement between you and The Health Conscious Diva with respect to the subject matter hereof and supersede all prior agreements between the parties with respect to their subject matter.
